Aloha Councilmembers,

I am writing to urge you to defend the Hawaii County law in court.

First and foremost, there is every reason to believe we will prevail in this case, and do so clearly and easily. Among other facts, there is no mention of GMO in state law, therefore it is indefensible to say that state law preempts counties from regulating GMO. This will not be a costly effort nor will it be difficult. For information on this opinion, see the Amicus brief filed on our behalf by Earthjustice, which explains this principle clearly.

Secondly, the democratically expressed will of the people must be defended. We cannot allow corporate interests to negate the laws that Hawaii County passes without even a fight to defend them.

Please stand up for the citizens of our island, for our right to home rule, a fair and open democracy, the protection of our island’s economy, and your power to be the rightful legislative arm of our government.

Support County Reso 22-14.  It will support our appeal of the judge’s ruling invalidating our GMO bill.

SUPPORT the Court APPEAL to reinstate of OUR GMO ban county law!!!

The Hawaii County Council will be deciding on Wednesday December 17th at 9am, West Hawai`i Civic Center – whether or not to appeal the ruling overturning our GMO Ordinance 13-121, which protected Hawaii Island from any new propagation of genetically engineered seed or open air testing.
Reso 22-14 will support our appeal of the judge’s ruling invalidating our GMO bill.
 * The Hawaii Center for Food Safety has started an online petition asking the Hawaii County Council to SUPPORT a motion to APPEAL Judge Kurren’s ruling which overturned Ordinance 13-121. This appeal is critical in getting this case heard by a higher court. Please sign and forward/share.

Annual Christmas Appeal

Dear friends,                                                                                      December 2014

     I write to ask for your help to sustain the work of Malu ‘Aina. Malu ‘Aina has been planting seeds, sharing food with people in need, and standing up for peace, justice, aloha ‘aina (love for the land) and a living planet for 34 years. You have been an important part of that effort in one way or another, and we thank you for your solidarity in the journey.

     The work for peace, justice, and the environment, like farm work, is never ending. As an all-volunteer organization we do our best to carry on. We know that we can’t do it alone. We can always use more help. We need your financial support and we need the next generation to carry the torch of nonviolence and the spirit of aloha in the work of Malu ‘Aina.

     The widening gap between rich and poor, the growing number of hungry and homeless, the endless wars, private prisons for profit, and corporate GMO domination of agriculture, all speak to a broken system that benefits the few at the expense of the many. It’s a system whose main concern is short term profit despite long term consequences. Catastrophic climate change and poisoning of air, water, and land, and people, plants and animals are secondary concerns to the corporate bottom line.

     Together, we realize that positive change doesn’t come from the top down. It comes from the bottom up. It takes grassroots organizing to clarify vision and unite people for the common good. We have our work cut out. We need to unite issues of peace, justice and preserving the earth realizing that an injury to one is an injury to all. Your support and solidarity helps us from being discouraged by setbacks along the way and to never, NEVER, give up. Blessings of the season to you and your loved ones.

We all worked hard to get this bill pass and we cannot let it slip by without any comment and an attempt to have it heard in a higher court.
Better yet…. sign the petition AND then let your voice be heard next Wednesday at 9 in Kona when the council will hear PUBLIC testimony and discuss the motion to appeal. The satellite council stations will be open if you are not in the Kona area.

Dear Lyn,Because of its year-long growing season, Hawaii has become the epicenter of genetically engineered (GE) organism experimentation and the production of commercial GE seed stock.

In response to this threat, last year Hawaii County put in place an ordinance (Ordinance 13-121) that would have banned most genetically engineered (GE) crops from being grown on the Big Island, with the exception of GE papaya.

After the ordinance was passed, the Biotechnology Industry Organization–the association for biotech companies like Monsanto and Syngenta–filed a federal lawsuit protesting the Ordinance. Center for Food Safety and Earthjustice helped the County defend the law in court.

But the day before Thanksgiving, U.S. Magistrate Judge Barry Kurren invalidated Ordinance 13-121, saying that such matters should be regulated by the state, not the county. The reality is that no such state laws exist to protect Hawaii Island’s biodiversity and environment from the pesticide drift, genetic contamination and degradation of soil, air and water quality associated with GE crop operations.

Tell the Hawaii County Council to SUPPORT a motion to APPEAL this misguided ruling.

The vast majority of both experimental and approved genetically engineered crops are engineered in order to be resistant to and withstand great applications of pesticides. These operations have dramatically increased pesticide usage across the State of Hawaii and the United States. This intense form of agriculture can harm the environment, agriculture and human health.

Hawaii County residents and their elected officials know what’s best for protecting the future of Hawaii’s agriculture, natural resources and wildlife. The principle of preemption is to prevent conflict between laws, such that the laws of the higher level of government prevail. In this case, there are no Hawaii State laws or regulations relating to the cultivation of genetically engineered seeds and crops, so the County’s ban on the cultivation of GE seeds should be the prevailing law on the matter.

The outcome of this case could affect all U.S. counties, because it is the first legal challenge to a county law of this kind. It is vital that the Hawaii County Council appeal the ruling and stand up for the rights of County to enact legislation to protect itself from the negative impact GE seed operations can have on agriculture and the environment.

Tell the Hawaii County Council to stand up for Hawaii County and SUPPORT a motion to APPEAL this misguided ruling!

NASA Study: Irreversible Collapse Likely

A major, multi-disciplinary study combining the perspectives of theoretical mathematics, natural and social sciences and — gasp! — history, among others, has concluded that a total, irreversible collapse of the world’s industrial civilization is both likely and imminent. The peer-reviewed study, which has been accepted for publication in the journal Ecological Economics, confirms in detail the conclusions of my 2009 book Brace for Impact, the premises of The Daily Impact, and the scenario of my forthcoming novelTribulation.

The study (reported in detail in Britain’sGuardian newspaper and few other places) finds that contrary to popular assumptions, the precipitous collapse of technologically advanced, wealthy civilizations is not rare, but common in the history of the past 5,000 years. And the common cause of collapse, it concludes, is depletion of natural resources accompanied by extreme stratification of the population into a small, super-wealthy elite and an increasingly deprived population of “commoners.”

The factors that have contributed to past collapses, and therefore should be examined for clues to an impending collapse, are five in number: 1) population (getting too big), 2) climate (changing), 3) water (disappearing), 4) agriculture (unable to keep up with 1, partly because of 2 and 3) and 5) energy (see 4).

An analysis of the “improvements” in the productivity of agriculture and other industries for 200 years have involved drastically increased consumption of finite natural resources. When mathematical models are run that calculate the consequences of the world’s current trajectory, the study says, “we find that collapse is difficult to avoid.”

“While some members of society might raise the alarm that the system is moving towards an impending collapse…” [Hello? HELLO! Over here!] “… and therefore advocate structural changes to society in order to avoid it, Elites and their supporters, who opposed making these changes, could point to the long sustainable trajectory ‘so far’ in support of doing nothing.”

Another frequent argument advocating doing nothing relies on the faith that technology will invent a way out that does not require any sacrifice. That assumption, too, is obliterated by this study, which finds that in the past, technological improvements that increase efficiency, at the same time increase per capita consumption and the depletion of resources. (It has often been observed, for example, that people who buy high-gas-mileage cars end up driving more miles, because each mile is cheaper, and consuming more gasoline than previously.)

It is apparently still a law, written somewhere and enforced somehow, that no matter how fully you demonstrate that the practices of the industrial overlords are taking civilization itself over a cliff, you must end with a Pollyannish song of optimism, and this brutally honest and unflinching study is no exception. All we have to do, it says in conclusion, to avoid the end of the world as we know it, is change immediately the behavior of everyone on the planet to reduce their consumption to a sustainable level, and make the distribution of profits equitable.”

Oh, good. I was afraid it was going to be hard.
