 60 Day Legal Notice to Enforce the ESA on the US Navy and RIMPAC

Dear Mrs. Case,

As Chair Person of the Hawaii DLNR you are head of law enforcement and bound by law to enforce the US Endangered Species Act (ESA) here in Hawaii. When you took your oath of office you swore to uphold US and State Law.

The federal and state ESA claims ” Any employee or agent of the department upon whom the board has conferred powers of police officers, including the power to serve and execute warrants and arrest offenders, or issue citations throughout the state, and any police officer of the counties of this state shall have the authority to enforce any of the provisions of this chapter or any rule adopted under this chapter”.

Furthermore, it has been determined in court “That the Willful Omission of enforcing the ESA can be considered a Take under the law itself”. Which means that you are obligated to enforce this law.

I know you are well aware of the wording in the ESA and are aware of the need for the Navy to do a Habitat Conservation Plan before operating in the habitat of Hawaiian endangered species. The reason I know you know this law is because in December of 1998 you attended and graduated from the same class I did in California which was hosted by the US Fish and Wildlife Service and Craig Potter who wrote the ESA in 1973. The class was called “Endangered Species Act and Habitat Conservation Planning. You are listed on the attendance sheet as “Suzanne Case : The Nature Conservancy: 201 Mission Street 4th FL San Francisco CA : 415-281-0466.

During that class we were both give many legal quotes out of the ESA itself and also many court case studies.

We were presented by the top environmental attorney firms in the USA and Craig Potter himself these quotes about the ESA.

1. ESA Section 7 requires that EVERY Federal agency consult with the Fish and Wildlife Service (FWS) to ensure that the agency actions are “not likely to jeopardize the continued existence or ANY endangered species or result in the destruction or adverse modification of designated critical habitat of such species.

I can prove that the war ships off our coastline during RIMPAC and the US Navy five year long electronic microwave war testing here in Hawaii is “likely” to jeopardize the critical habitat of the endangered green sea turtle, hawksbill turtle and monk seal. These ships put out billions off watts of electromagnetic energy they discharge into the sea and they are using high intensity sonar. Both of these events harm, harass and take our endangered species.

2. 16 U.S.C. 1536 (a)(3)(4), 50 C.F.R. 402.14 legal code claims that : If the agency determines that an endangered species MAY be present in the area affected by the action and proposed actions is LIKELY to effect the species the ESA REQUIRES consultation.

NOAA has already determined that all Hawaiian waters are critical habitat for the monk seal because these endangered species travel in between islands! Plus the very rare hawksbill turtle travels between islands and the baby green sea turtles live out at sea for the first part of their life. So it is obvious that the wide area of sea that the Navy is discharging electricity into, blasting with explosives, sinking ships with bombs and using massive amounts of sonar and underwater (DARPA) tested electronics to track and destroy submarines is “likely” to harm, harass and take our endangered species.

3. Section 7 V. Section 10 of the ESA is a process by which FEDERAL agencies obtain permission to “TAKE” endangered species. The Navy must file for and receive an Incidental Take Permit to START RIMPAC or their microwave war test.

Section 7 outlines the process that the Navy must take to get a permit to operate in the habitat of our endangered turtles, whales and monk seas. This process is called an HCP. It is described by law as:

Habitat Conservation Plan Is a plan describing the ANTICIPATED effect of proposed taking on the affected species and HOW that TAKE will be minimized and mitigated for : the plan is submitted with and Incidental Take Permit.

No HCP was done or submitted by the Navy to operate RIMPAC! RIMPAC is in direct violation of the most powerful environmental law ever adopted by a country on our planet.

Commander Bruce Hay from PMRF open told all of us on the KKCR radio show and in a private meeting with the top PMRF officials “RIMPAC 2014 had no way to monitor the effects on the sea turtles and coral reefs”. He further said “RIMPAC 2016 will be operated just like RIMPAC 2014 and the Navy has NOT done an environmental study ahead of time or a Habitat Conservation Plan”.

The ESA has been held up in court against the US Navy in dozens of law suits filed by the NRDC and Earth Justice and once again it looks like we must go to court to force the Navy to follow our Endangered Species Act, Marine Mammal Protection Act and Clean Water Act.

As a citizen of the USA I have the LEGAL right to make you enforce the ESA onto the Navy. I have the legal right to sue the Navy, NOAA, and the DLNR for violating the ESA and, or lack of enforcement of the ESA.

This is called a Citizens Suit. It is described in the ESA section 11 as : To enjoin any person, INCLUDING the United States of America and other governmental instrumentality or agencies, who allege to be in violation of the ACT or its implementing regulations.

Craig Potter who wrote the ESA said ” This is the peoples law” because the people own the wildlife, not the government.

Well I am “the people” and I wish to formally allege that the US Navy is currently in Violation of the ESA for not doing the needed Habitat Conservation Plan before RIMPAC started. I allege that you are violating the ESA for lack of enforcing the ESA onto the military. I allege that very same actions on NOAA for their lack of enforcing the ESA onto the military.

I am alleging these violation on behalf of the endangered sea turtles, whales, monk seals and their coral reef habitat because I have direct proof via HD video with time, date and GPS of the US Navy and their guest during the 2014 RIMPAC harming, harassing and taking our endangered species.

Since Commander Bruce Hay said “that RIMPAC 2016 will operated like RIMPAC 2014” and we know the capabilities of the ships currently involved in RIMPAC today we easily have the “Likelihood” that these current operations are effecting the habitat of our endangered species. Therefore by law the military needs to stop ALL activities in Hawaiian waters and do the needed Habitat Conservation Plan and acquire the needed Incidental Take Permit to resume their destructive activities!

Please look at this letter as a legal 60 day notice under the ESA to force you to enforce the ESA on the US Navy. This is the responsibility of the oath of office you hold.

I would be more than happy to meet with you and your legal council in person and go over all of the documented proof I have of the violations of the ESA the Navy has committed. I already had a high profile meeting with the Navy brass in Kauai of which they did NOT dis agree with any of these violations!

Statement on the Orlando Killings

No More Violence! No More War!

I grieve with the families of innocent victims in Orlando Florida. The horrific violence carried out Sunday June 12, 2016 against members of the LGBTQ community at the Pulse club by Omar Mateen is difficult to comprehend.  How could anyone do such evil?  Certainly the availability of military style assault weapons in the U.S. contributes to such massive casualties –49 dead and 53 injured. But it doesn’t explain the source of such hate and violence.  More is becoming known each day.  Several news sources now quote statements made by the shooter, Omar Mateen, on Facebook in the early morning hours of the shooting. “You kill innocent women and children by doing US airstrikes..now taste the Islamic state vengeance.” http://abcnews.go.com/US/orlando-shooter-facebook-now-taste-isis-vengeance/story?id=39875518

In short, innocent lives killed for killing innocent lives. An eye for an eye. A cycle of violence. Vengeance for vengeance. Killing and more killing without end. Solving the escalating killing of innocents will require more than banning military style assault weapons, though that is a start. What about the innocent lives killed on the other end of official U.S. military assault weapons – weapons of war? Are innocent women and children killed abroad by U.S. airstrikes, drones, special ops, etc. of less value than innocent people killed at home in Orlando? Get copies of files the Government may have on you

This is easy print out form letters.  Takes very little time.  Might be interesting to see what pops up in terms of government monitoring of peace, justice, independence activity.
I sent letters in April 2016.  The FBI responded recently saying they have 1304 pages on me.  It will cost me $40 to get 3 CDS with the pages in them or $60 for paper pages. I’ll keep you posted of anything interesting when i get my 3 FBI CDs.

The UN Charter and the UNESCO Constitution have formulated the key peace idea: “That since wars begin in the minds of men, it is in the minds of men that the defences of peace must be constructed.” If the war minds received a powerful rooting in military science, founded more than two centuries ago, which now concentrates military intellect with invention of the most devastating weapons of mass destruction, the defences of peace minds were left fragmented and powerless before the war without their science up to now. Therefore humanity has not been able to put an end to the wars so far. The war minds seem invincible for the defences of peace minds as long as they remain outside and without science. If this dependence is true and is recognized by the UN and UNESCO, the main aspiration for them ‘must be constructed’ peace science. Unfortunately, the world community does not see it. To overcome this lack, we, the undersigned, offer you to discuss peace science.

The first version of this science – Global Peace Science (GPS) – was completed in the Global Harmony Association (GHA) for 11 years by the 174 co-authors from 34 countries and was published in English in 2016.** This project joined dozens of different authors and integrated almost all diversity of constructive peacemaking ideas, relieving itself from their fragmented impotence before war and military science. This science, as the supreme, scientific understanding of peace, has all reasons to become the most powerful intellectual and technological alternative to military science and all wars, including prepared and matured nuclear war in the new “Barbarossa” spirit, which will be a catastrophe for humanity and the planet. Only GPS and its new peacebuilding technologies, which provide continuous pacifization and open a new era of humanity – the Peacefulness Age – is capable to confront it.

Therefore, the GPS intellectual potential, its technologies and its revolution of the peacemaking thinking, are deserving of the closest attention and the most careful discussion in the UN and UNESCO in order to further development of this science and its institutionalization in politics, peace culture and education to recommend it to all Members – States of the UN and UNESCO. This step practically will confirm your real aspiration to put an end to wars, finding them an alternative in scientific peace consciousness and in its new peacebuilding technologies. GPS will make a common platform for global sustainable disarmament during 50 years at 2% per year that without GPS is unthinkable and impossible.

The GPS development, including an International Scientific Contest for its best version, to which is dedicated the GPS special section, is the most favorable in the UNESCO Social and Human Sciences Sector (www.unesco.org/new/en/social-and-human-sciences/about-us/who-we-are/whos-who) under the UN aegis. The GPS development corresponds to the UN and UNESCO fundamental statutory demand: “Building peace in the minds of men and women,” which is impracticable without the peace science. Only with its help the UN and UNESCO may drastically lift their peacebuilding mission to provide humanity with the real dream and scientific project of purely peaceful sustainable development without wars in the 21st century. * Pacifization (or peacescienization) in GPS is universal process similar to globalization and informatization, embodying in the constant growth of reconciliation in global society as result of spreading consciousness and peacebuilding technologies of GPS. Not to be confused with the local attempts of violent reconciliation – with “pacification.”

** The GPS book in the Russian language has been completed by the 89 coauthors from 30 countries and was published in 2015 (432 pages) and in English – in 2016 (616 pp.). The unprecedented Global Peace Science (GPS or Peacescience), published at the book some name, was created in the Global Harmony Association (GHA) for 11 years since its establishment on February 15, 2005. Of these, 8 were the preparatory years, for which GHA has published seven previous books, discussed and approved 47 projects of global peace from harmony (Chapter 7.1). Work with GPS as the 48^th project began directly in March 2013.

In Russian language, this book of 432 pages by 89 coauthors from 30 countries was published in St. Petersburg, Russia, in January 2015:

The book coauthors are people of different age (from 9 to 90) and professions (from worker to academician and president of the country), 15 religious confessions and diversity of cultures from 34 countries in all continents, including 59 coauthors from the USA, 33 – from Russia, 15 – from India, 6 – from Canada, 5 – from Australia, etc. Only international group integrating in a harmonious unity the planet cultural diversity could create Peacescience.

Among the Peacescience coauthors are: former President of India – Abdul Kalam, the Nobel Peace Laureate from Northern Ireland – Mairead Maguire, intellectual peacemaking leader of the USA – Noam Chomsky, pioneer of peace studies from Norway – Johan Galtung, Chancellor of the IASE Pedagogical University of India – Kanakmal Dugar, sociologist of Catholic University from Belgium – Francois Houtart, leader of the women’s peace-making organization in Africa – Ayo Ayoola-Amale of Ghana, researcher of the Roerich creativity – Julia Budnikova from Russia, director of the Finance Institute, academician from Kazakhstan – Uraz Baimuratov, one of the Indian yoga leaders – Ramesh Kumar and many other outstanding scientists and peacemakers (6). Initiator, editor in chief and manager of the project is Leo Semashko, GHA Founder and President, Russia.

The contribution of these authors in GPS for three years composed 309 articles, including Leo Semashko 101 articles (81 solo and 20 coauthorship), Subhash Chandra 17 articles (10 solo and 7 coauthorship), Charles Mercieca 6 articles (5 solo and 1 coauthorship), Johan Galtung 5 articles, etc.

The book 309 articles are united into its 13 Chapters, 3 Sections, 2 Parts, Annex and Philosophical Final, which have been a collective discussion and approval of the GHA members. Diversity of opinions is complemented a variety of more than 600 sources in the book bibliography on 17 pages (580–597).

The GPS book is published on the GHA 72 members donations gathered in 2014 and amounting $8.677. It is the first budget of global peace in the history in 2015. Its comparison with the world military budget this year, nearly $ 2 trillion (according to unofficial data it is several times more), shows the militaristic, self-destructive priority of the global ruling elite and its national governments. Unfortunately, humanity has long reconciled with this priority and it is not looking to change it that is possible only on the GPS basis.

We will not talk about the shortcomings that Peacescience are full as the first attempt of similar science. We will emphasize its key advantages and significance.

1. Uniqueness. Peacescience is incomparable to anything else today. Mankind today does not have any similar or comparable knowledge of global peace, alternative to military science that has arisen over two centuries ago in 1799. GPS is able to overcome this lag of peace from war and create a fundamental alternative to military science and militarism in general. Uniqueness of GPS is determined by the discovery of SPHERONS – deep harmonious social structure of society in all its historical forms. This unknown up to GPS creation deep structure is peaceful on its objective nature and the key for scientific understanding global peace.

2. SPHERONS’ discovery. GPS is based on the unprecedented social discovery of universal and harmonious classes of the population in a whole – SPHERONS employed in four spheres of social production, which is possible only in peace. Therefore SPHERONS are fundamental actors not only production but also global peace at all social levels, starting from the family. SPHERONS constitute a deep and eternal social structure of society as a whole and all its parts, without exception, in all its historical forms (Chapters 1 and 2). The discovery of SPHERONS has a revolutionary cognitive, social and political (democratic) significance for society.

This discovery is complemented by the discovery of Socioeconomic Harmony Paradigm: “D + 3D”, which expresses the spiritual/ethical basis (“D” – of Russian “Duh” – spirit) of harmonious development and adequate to it the development of other three “D” spheres: demography (Sociosphere), democracy (Orgsphere) and demo-economy (Technoecosphere). The essence of a Harmony Basic Law in this paradigm is priority elevation of the spiritual needs for the individuals and society, which is opposed to disharmonious Law of destructive domination of material needs. (It is Academician Baymuratov’s Paradigm, 2014, Kazakhstan. See Chapter 8.15).

3. Integral, holistic character and dynamism. Peacescience, thanks SPHERONS universality, allows to synthesize and preserve in itself the peacemaking achievements of the past and future evolution (Chapters 3, 4, etc.). It provides a holistic approach to solving the problems of global peace at all levels. GPS does not pretend to finality but it assesses itself as “the initial version”, which does not exclude other options and is ready to enter with them into international scientific Contest (Chapter 8, etc.). It supposes the possibility of another interpretation for deep social structure.

4. Value of Peacescience. In any case, regardless of the Peacescience truth measure of its various theories, it is an undoubted epistemological achievement and social value as the first in history precedent of scientific knowledge of global peace in a whole (history does not know other similar examples). Therefore, following the wise Italian saying “If it is not true, it is well conceived,” (se non è vero, è ben trovato) about Peacescience can say that even if it is not right in all parts, it is well conceived and certainly useful to mankind. Peacescience opens for it the way of search and upgrading an absolutely necessary for it science and fundamentally new, breakthrough knowledge, enriching it and saving it from wars, from which it is still (for the 6 thousand years of history) not has the radical vaccine and spiritual immunity. It is the way of conscious geopolitics of SPHERONS’ peace under the Earth Constitution International Law. Peacescience opens the Peacefulness Era of humanity since 2016.

The completion of the Peacescience book in GHA is just the beginning of a new, broader development, dissemination and application of the GPS new paradigm of thinking in academic, educational, political, religious and other cultural institutions.

Resume. Peacescience from harmony defines the THIRD, harmonious and just way of humanity development in all its four spheres. The third way organically integrates the advantages and softly (non-violently) overcomes the pathological extremes of the two equally disharmonious and violent, traditional for the 20^th century ways: socialism and capitalism and their basic ideologies: Marxism and liberalism. The past and the beginning of the new century showed that without scientifically conscious and realized social harmony live further in a nightmare of any militaristic form of traditional society, mired in endless wars, terrorism, murders, crimes, corruption, lies, elitist-totalitarian pseudo democracy of billionaires behind the screen of the elected puppets, drugs, glaring inequality, and other pathologies on the brink of the world’s nuclear suicide is impossible. GPS offers a way out of their impasse through science, education, culture and democracy of SPHERONS as the political center of the federalist Earth Constitution (Chapter 8.19). Therein lies the GPS historical significance.

The fate of humanity and its key countries in the 21st century with different cultural, economic and political orientations: Russia, China, India, EU and the US, will be determined by the recognition of GPS and its democracy of SPHERONS (spheral democracy) ensuring the dominance of spiritual elevation, social priority of children and women, geopolitics of global peace, general and complete disarmament and economic prosperity for all nations from their harmony as one family on one planet.
