Hawaii Island needs your support.

This is a reminder and update about the upcoming county council meeting where the council will vote on Comm 9.1, which if passes means the county corporation counsel, who is charged with defending Hawaii County’s GMO crop ban in court, will be able to hire Earth Justice and the Center for Food Safety attorneys Paul Achitoff and George Kimbrel, respectively. Hawaii County has already voted to appeal the lower court’s decision invalidating our GMO crop ban; at this juncture passing this is even more about our county leaders following through and carrying out the financial and fiduciary responsibilities than the issue of whether GMOs should be banned or not. Certain council members have been swayed to vote against free high quality representation, perhaps partially by or under the cover of the confusing letter that the plaintiff’s attorney sent to all the council members to – of all things- give advice to the ones they are suing, Hawaii County. Obvious conflict of interest aside, these claims that “Paul Achitoff cannot represent the county” are groundless.

CFS and Earth Justice are funded by small donations all over the country, and they do great work. The world is paying attention to this case because if we don’t win in a higher court, this would have possibly grave consequences for the future of GMO ordinances throughout the country, as well as the cases on Kauai and Maui. You are the movement, be heard and be counted.

Senator Russell Ruderman wrote a powerful testimony in support of Comm 9.1 , here it is:

“Aloha Councilmembers,

I sincerely hope you will vote to accept the assistance of Earthjustice and others in defending the County.

The defense of this bill is not about GMO’s – it is much more than that. Defending your County authority will be useful in many future subject matters. If you do not defend the County’s authority here, in the future this precedent will work against you in other matters where you will desire County authority, regardless of your opinion on this issue.

As you’ve heard in testimony, this assistance will not cost the County, as Earthjustice will donate their services, and only incidental fees may be incurred as required by their charter.

Thus, you will be saving the County large sums of legal costs by authorizing this assistance. In addition you will have the best expert in the state on our side. Conversely, as you’ve already chosen to defend the County, rejecting this assistance will result in undetermined costs to the County. These costs are potentially significant and unnecessary. They can be avoided by allowing this expert, highly competent assistance, thereby saving your constituents money.” -Senator Ruderman

Those voting against this should also be asked how they justify spending taxpayer money when we’ve been offered representation for free.

Three notable bills were introduced this week at the state level.

Senate Bill (SB) SB593 Requires the Agribusiness Development Corporation, within the Dept. of Ag to: a) make increasing agriculture and local food production its primary mission, b) lease 50% of its land to operations that support increasing agriculture and local food production within the next ten years, and c) establish a sustainable agriculture and local food production plan. *NOTE: Hearing TOMORROW Monday, Feb. 2nd on SB593.

Disappointed in your vote on Res 22-14

Hawaii County Council voted 5-4  in support of Res 22.14 to appeal Judge Barry Kurren's decision against Hawaii County's GMO ban law.

Thank God for Council Chair, Dru Kanuha, voted FOR Res. 22-14.  His vote saved the male reputation.  Otherwise it would have been all females For and all males Against.

Aloha Council members,

Like you, I sat through many hours of testimony today and was very moved by what I heard from a broad cross section of our island in support of Res. 22-14. (As usual Dennis Onishi was absent for much of the testimony.) I was especially moved by young Hawaiian families, the children speaking for their future of aloha aina, and even Vietnam vets making links between Agent Orange chemical warfare and the toxic chemicals used in GMOs produced by the same companies.

Fair and open democracy is under attack all across the U.S. by big money vested interests. It is concentrating more and more power in the hands of a few.  Corruption is blatant.  Big money is buying votes.  The higher you go the more money will flow. In many areas Big Money is succeeding: Wall St. deregulation and FDIC insuring derivatives, spiking campaign contribution by the super rich, giveaways of public lands for fracking, and the effort to require labels on GMO foods.  Counties throughout Hawaii have been different.  People have spoken up and their votes and voices counted in passing local ordinances to control GMOs.

I was very disappointed to see that you voted NO on Res. 22 – 14 to deny our GMO law to go through the court process on appeal. By your vote you have taken a clear stand, not only against the voice of the people of Hawaii County but our right to our day in court.   This issue is about our right of Home Rule in standing up to powerful corporate interests.  Instead of standing with us, you have chosen to stand with money and power.  In short you have chosen to stand for corporate occupation of government, corporate occupation of our economy, our food and our future.  Instead of standing for aloha aina, and the vision and hopes expressed by all the people, especially the young people, who testified so eloquently today, you have chosen to stand for the short sighted profits of chemical warfare companies that don’t give a rip about the children and future of Hawaii County.  Greed is their game and poison is their name.

Shame on you Aaron Chung, Dennis Ohishi, Greggor Iligan, and Danny Paleka.  You disgrace yourselves, your families, your public office and the democratic process.

These are strong words but I want you to know that I never give up on anyone, including myself.  I believe in redemption, but Mama Aina, the living God, is telling all of us that we are pushing the limits.  Poisons in our air, water, soil, rising cancers, climate change, intense storms, etc. etc.  She is telling us in terms that are crystal clear: we better listen and change our ways.  Time is running short.

Aloha Councilmembers,

I am writing to urge you to defend the Hawaii County law in court.

First and foremost, there is every reason to believe we will prevail in this case, and do so clearly and easily. Among other facts, there is no mention of GMO in state law, therefore it is indefensible to say that state law preempts counties from regulating GMO. This will not be a costly effort nor will it be difficult. For information on this opinion, see the Amicus brief filed on our behalf by Earthjustice, which explains this principle clearly.

Secondly, the democratically expressed will of the people must be defended. We cannot allow corporate interests to negate the laws that Hawaii County passes without even a fight to defend them.

Please stand up for the citizens of our island, for our right to home rule, a fair and open democracy, the protection of our island’s economy, and your power to be the rightful legislative arm of our government.
